Mediation & Alternative Dispute Resolution

Mediation & Alternative Dispute Resolution

Mediation is a facilitated negotiation. It is a process by which a neutral third party, the mediator, assists disputing parties in reaching a mutually satisfactory resolution. It is a non-adversarial approach to conflict resolution where the parties may communicate directly. The role of the mediator is to facilitate communication between the parties, assist them on focusing on real issues of the dispute, explore alternatives to litigation, and generate options for a settlement. Such exploration of alternatives has been a direct result of the often-voiced frustration and disappointment associated with the use of our justice system as a means of dispute resolution. The goal of the mediation process is for the parties to create a mutually acceptable resolution of the dispute which will allow them to avoid expensive, inconvenient, and stressful litigation.

Mr. Weaver has been a mediator for the Circuit Court for Frederick County and other courts since 2001. Mr. Weaver has also served as a mediator for the Maryland Association of Realtors. As an adjunct professor at Hood College, Mr. Weaver taught a class in negotiation and conflict resolution.
